The collective obviously paid martinez in March as part of an agreement for him to play in the 2024 season. Shouldn't there be as part of the "contract" that if martinez decides not to play for oregon stare in 2024 that some or all of the payments leading up to the 2024 season must be paid back. Seems ridiculous to pay that kind of money without assurance that the "contract" be fulfilled.

I look at it this way. In my opinion he isn't an employee, he is an independent contractor. If I paid somebody a partial payment upfront to do X job and that somebody walks away I'd think I'd have a case to get my money back. But since it makes sense it probably wouldn't work that way.

If I paid somebody a partial payment upfront to do X job and that somebody walks away I'd think I'd have a case to get my money back. But since it makes sense it probably wouldn't work that way. Yeah I'm the last person to argue that labor laws are straight forward. At some point a contract is only as good as what people will sign. If a player has a contract that has a lot of penalties and restrictions and a contract that doesn't they will probably take the better option. We really aren't in a position of power when it comes to keeping and retaining the players we would need to stay relevant in the national championship race.

It really beating a dead horse at this point. But, I can tell you Kyle debated long and hard whether to even be interviewed. He does not want to be in that position. Nor have collective amounts, processes, relationships inline for public scrutiny. He was very gracious to DM and not get into details of what a player said, rumored to others vs the actual "potential" of the agreement and the requirements for it to be maximized. Also not really touching on DM backtracking on his, "the NIL lied" BS. Kyle confirmed the quarterly... and subtraction. He did not state how it was arranged/pd out or specifics. The NIL provides opportunities thru other entities besides collective $ directly for a total #. Nor was there a guarantee to any specific amount (as indicated) as it varied greatly for "work" provided. But, as with most "contracts" it's a bit convoluted and full of parts that will not be public and thus rumor filled BS.
